The Sixteenth Judicial District Commission on Judicial Performance unanimously recommends that Judge Michael Schiferl Be RETAINED.


Background: Judge Schiferl has been a District Court Judge since 2002. He earned a Bachelor of Science degree from University of Southern Colorado and a law degree from Gonzaga University. Prior to his appointment to the bench, Judge Schiferl served as a Deputy District Attorney and a private practitioner.


Strengths: Judge Schiferl has been actively involved in creating the Sixteenth Judicial District Drug Court and the Sixteenth Judicial District Teen Truancy Court. Judge Schiferl is actively involved in pro bono programs and serves on several statewide judicially related committees. Since his last evaluation, Judge Schiferl has shown marked improvement in the quality of his orders, the timeliness of the same and the soundness of his decisions. Judge Schiferl has rated highly for his judicial temperament and the civility demonstrated in his courtroom. Attorneys strongly noted and appreciated his judicial temperament, the respect shown to all participants and his control of his courtroom. Non-attorneys consistently noted his patience, openness, fairness and compassion.


Weaknesses: Judge Schiferl was encouraged to continue to develop his written rulings in civil matters and to shorten the delays incurred in presenting the same.


Recommendation: Of all attorneys surveyed about retention, 72% recommended to retain, 23% not to retain, and 6% expressed no opinion. Of those expressing an opinion, 76% recommended to retain and 24% not to retain. Of all non-attorneys surveyed, 86% recommended to retain, 6% not to retain, and 7% expressed no opinion. Of those
expressing an opinion, 93% recommended to retain and 6% not to retain. (These percentages may not total 100% due to rounding.)
