The Fifth Judicial District Commission on Judicial Performance unanimously recommends that Judge Rachel J. Olguin-Fresquez BE RETAINED.

Judge Olguin-Fresquez was appointed as Clear Creek County Court judge in May 2006. Judge Olguin-Fresquez left her position as the chief deputy district attorney for the Fifth Judicial District, Colorado, after serving as a criminal prosecutor in the Fifth Judicial District for approximately seven years.

The Commission reviewed written evaluations of Judge Olguin-Fresquez from attorneys and non-attorneys, as well as a written self evaluation completed by Judge Olguin-Fresquez. A personal interview of Judge Olguin-Fresquez was conducted by the Commission, and members of the Commission observed Judge Olguin-Fresquez in the courtroom during several proceedings.

The Commission is highly impressed with Judge Olguin-Fresquez’s performance and abilities after only a relatively short period of time on the bench. She is fair and unbiased, open-minded and understanding, and intelligent and professional. She treats people with compassion and respect and works very hard to make sure that everyone appearing in front of her fully understands the proceedings. She is consistent in her rulings, reflecting the needs of the community with a fair application of the law and sound legal reasoning. With more experience and opportunities for learning, she should improve her skills in handling civil matters, assisting civil litigants in resolving their disputes more effectively and efficiently. She generally demonstrates excellent docket management, giving all parties an opportunity to be heard, allotting adequate time to handle matters before her, yet keeps things moving along. Judge Olguin-Fresquez is both professional and approachable, bringing a sense of dignity and respect to the bench and a more positive experience in the courtroom for those who appear before her.

Questionnaires received by the Commission from both attorneys and non-attorneys that have appeared in her courtroom uniformly rate Judge Olguin-Fresquez high overall, and above average in the areas of application of the law, demeanor, diligence, and fairness. 77% of attorneys responding to the questionnaires strongly recommend retention of Judge Olguin-Fresquez, with 85% of responding non-attorneys sharing this strong recommendation.
