The Twenty-First Judicial District Commission on Judicial Performance unanimously recommends that Chief Judge David A. Bottger BE RETAINED.
Judge Bottger was born and raised in Ohio. He received his undergraduate degree in economics from Ohio Northern in 1973. He obtained a law degree in 1976 from the University of Notre Dame Law School.
Judge Bottger was in private practice from 1977-1983. In 1983 he was appointed as a Magistrate for the Twenty-First Judicial District. In 1987 he was appointed as a District Court Judge. Judge Bottger became the Chief District Court Judge in 2005 and continues to serve in that role. He is a member of the Mesa County and Colorado Bar Associations, works with local academic teams and lectures at schools.
Judge Bottger was evaluated through attorney and non-attorney surveys, a self-evaluation, courtroom observations, review of written decisions and an interview with the Commission. In all areas Judge Bottger was found to be exemplary. In particular, the Commission found him to be hard-working, knowledgeable about the law, and fair-minded.
Attorneys and non-attorneys rated Judge Bottger higher than the average for all district court judges in Colorado: 97 percent of the attorneys recommended that Judge Bottger be retained, as compared to 90 percent for the state-wide average for all district court judges; and 98 percent of non-attorneys recommended retention, as compared to 94 percent for the state-wide average.
