The Fourth Judicial District Commission on Judicial Performance recommends by a unanimous vote that Judge Gregory R Werner BE RETAINED.
Background: Judge Werner was appointed to the Fourth Judicial District Court in 2006. He graduated from Moffat County High School, magna cum laude from the University of Colorado, and the University of Colorado Law School. Before his appointment to the Court, Judge Werner was an associate attorney at Paul S. Edwards and Associates. His community interests include scouting as an assistant scoutmaster, mock trial competitions, Teen Court, and he serves as the District Court representative on the Justice Advisory Council. He regularly speaks to elementary schools. Judge Werner’s docket consists of civil and criminal cases.
Strengths: Attorneys who responded to survey questions rated Judge Werner above average for: case management, application and knowledge of law, communications, demeanor, and diligence. The Commission also reviewed various opinions that Judge Werner wrote. His opinions appeared to be well-reasoned, clearly written, and adhered closely to precedent as well as to constitutional and statutory law.
Weaknesses: Balancing efficiency and docket control with giving cases the time and attention that they may need.
Recommendation: In making its recommendation, the Commission considered the results of surveys from attorneys and non-attorneys, a self-evaluation by the judge, courtroom observations, written decisions and orders and an interview with Judge Werner before the Commission. Ninety-two percent of attorneys surveyed and 94% of non-attorneys surveyed recommend that Judge Werner be retained in office.
