The Second Judicial District Commission on Judicial Performance unanimously recommends that Judge Andre L. Rudolph BE RETAINED.
Background: Judge Rudolph was appointed to the Denver County Court in September 2004 and took the oath of office in January 2005. Prior to his appointment, Judge Rudolph was an Adams County magistrate for the Seventeenth Judicial District. Judge Rudolph began his legal career in the Colorado Public Defender’s Office. He received his undergraduate degree from the University of Wyoming at Laramie and his Juris Doctorate from Creighton University School of Law in Omaha, Nebraska. Judge Rudolph currently presides over traffic, criminal, and traffic infraction matters. Judge Rudolph is active in community services. He believes it is important for judges to be involved in community service activities and projects. Judge Rudolph received the 2003 Distinguished Jurist Award from the Sam Cary Bar Association and the 2001 William G. Meyer "Drug Court Employee of the Year" award.
The Commission reviewed written evaluations of Judge Rudolph from attorneys and non-attorneys, which include written comments. The Commission also considered a written self-evaluation completed by Judge Rudolph, and three written orders issued by Judge Rudolph. The Commission also conducted a personal interview.
Strengths: Judge Rudolph received slightly higher than average ratings from attorneys in the areas of promptly making rulings during trial; assisting parties to reach agreement; promptly issuing a decision on the case after trial; willingness to reconsider error in fact or law; issuing consistent sentences when the circumstances are similar; not engaging in ex parte communications; and doing the necessary ‘homework’ and being prepared for his cases.
Weaknesses: Judge Rudolph received slightly lower than average ratings in the areas ofbeginning court on time; willingness to make decisions without regard to possible criticism; treating everyone involved politely; treating participants with respect; and conducting his courtroom in a neutral manner.
Recommendation: Of the attorneys responding to the questionnaire, 94% recommended that Judge Rudolph be retained. Of the non-attorneys responding to the questionnaire, 99% recommended retention.
