The Thirteenth Judicial District Commission on Judicial Performance recommends that Judge Penny BE RETAINED.

Judge Penny was appointed to the Kit Carson County Court Bench in 1977 and has served for 19 years. Judge Penny hears criminal misdemeanor, traffic, traffic infraction, and civil cases in his court on a part-time basis. He maintains a general practice of law in Burlington in addition to his judicial duties.

Evaluations received from attorneys, courthouse personnel, and litigants rated Judge Penny very highly. The Commission’s impression of Judge Penny received at a personal interview with him is that he very adequately and competently carries out his duties as a rural county judge. The overriding impression is one of fairness and impartiality in his decisions.
