The Fourth Judicial District Commission on Judicial Performance unanimously (10-0) recommends that Judge G. David Miller BE RETAINED.
Judge Miller was appointed to the El Paso County District Court on July 1, 2002. Immediately prior to his appointment Judge Miller practiced civil law in Colorado Springs. Judge Miller earned his Bachelor of Arts degree in 1979 from the University of Notre Dame, and his Juris Doctorate degree from Creighton University Law School in 1982. While attending law school, Judge Miller served as a Commissioned Officer in the United States Marine Corps and, upon graduation, served as a prosecutor and senior defense counsel with the United States Air Force Judge Advocate’s Corps until his separation from active duty in 1988. Judge Miller has served as the presiding Juvenile Judge since 2012. He has provided exemplary service to the Fourth Judicial District during his tenure both on and off the bench. Judge Miller has worked to improve the court process for juveniles, and spends a significant amount of time participating in a number of state and local committees, including an active Best Practices Team, whose efforts have resulted in many innovative improvements in the juvenile justice system, such as a more humane shackling policy during transport of incarcerated juvenile defendants to and from Court proceedings.
Judge Miller’s court docket presently consists of 40% civil cases, 40% juvenile cases, and 20% criminal cases. The Commission personally interviewed Judge Miller, observed him in Court, reviewed judicial performance survey results, reviewed several of his written opinions and orders, and considered written comments from attorneys and non-attorneys. Judge Miller’s overall combined performance score for all categories of respondents (attorneys, non-attorneys, jurors, law enforcement, defendants, litigants, and witnesses) was high at 3.84 out of 4.00, with a combined retention score of 99%. In response to the survey question “How strongly do you recommend that Judge G. David Miller be retained in office, or not be retained in office?” 96% of attorneys and 88% of non-attorneys who completed the survey strongly recommend retention.
Judge Miller is widely acclaimed for being fair, impartial, compassionate and intelligent, displaying a professional demeanor and temperament, showing the utmost respect to all participants in judicial proceedings, listening and giving ample time for parties to present their cases, efficient docket management, his knowledge of the law, and engaging in thoughtful consideration of the cases before him. Judge Miller was also praised for his problem-solving approach to juvenile cases, and his willingness to reconsider a decision in which he is alleged to have made an error. The Commission found his legal rulings to be thoughtful and well reasoned. Several survey respondents consider Judge Miller to be one of the best District Court Judges in the State, a sentiment with which the Commission agrees.
