The Seventeenth Judicial District Commission on Judicial Performance unanimously recommends that Judge Leroy D. Kirby BE RETAINED.

Judge Kirby was appointed to the Adams County Court in July of 2009. His current docket is roughly 50% civil and 50% criminal, in addition to which he has presided over the Adams County’s Drug Court since its inception. The first docket was heard in October 2011. Prior to being appointed as a County Judge he served as a District and County Magistrate in Adams County for two years. Judge Kirby served as a Deputy Public Defender for the State of Colorado from 1995 to 2007. Judge Kirby completed his undergraduate studies at Regis University in Denver and graduated from the University of Denver School of Law in 1995. Judge Kirby is a member of the Colorado and Adams County Bar Associations, and serves as a Commander in the United States Naval Reserves.

In arriving at their recommendation, commission members interviewed Judge Kirby personally after reviewing survey results provided by lawyers, parties, and other individuals who appeared in front of Judge Kirby or otherwise observed him in court. The Commission members also reviewed Judge Kirby’s self-evaluation, observed him in court, and reviewed a number of decisions rendered by the judge. The Commission found Judge Kirby to be an excellent judge who treats those who appear in front of him with respect, is fair and impartial, has a keen understanding of the law, and has a genuine interest in seeing justice done. Judge Kirby’s passion for the law and work in Drug Court is especially praiseworthy.

Performance surveys were sent to district attorneys, defense attorneys, and other attorneys appearing in criminal matters as well as attorneys representing litigants or otherwise appearing in civil matters. Surveys were also sent to non-attorney witnesses, law enforcement personnel, defendants, litigants, jurors, court employees, and probation
officers. In the anonymous survey results, Judge Kirby scored above the statewide average of all other county judges standing for retention on all survey questions. Of all attorneys surveyed about retention, 96% recommended to retain, 1% not to retain, and 3% were undecided or didn’t have enough information to make a recommendation. Of those expressing an opinion to retain or not to retain, 99% recommended to retain and 1% not to retain. Of all non-attorneys surveyed, 89% recommended to retain, 3% not to retain, and 7% were undecided or didn’t have enough information to make a recommendation. Of those expressing an opinion to retain or not to retain, 97% recommended to retain and 3% not to retain. (These percentages may not total 100% due to rounding.) Based on its review of survey results, review of several of Judge Kirby’s decisions, court room observations, and interview of Judge Kirby, the Commission unanimously recommends that Judge Leroy D. Kirby BE RETAINED.
