The Thirteenth Judicial District Commission on Judicial Performance recommends by a unanimous vote that Judge Kevin L. Hoyer BE RETAINED.


Background: Judge Hoyer was appointed to the District Court bench in 2005. He graduated from University of Colorado with a degree in History in 1977, and received his law degree from the University of Colorado in 1980.
Prior to his appointment to the District Court bench, Judge Hoyer was in private practice for 25 years, and in addition, served as the Washington County Court Judge for 18 years. Judge Hoyer’s community interests include membership in his local Lion’s club, and active participation in his local church, where he serves as a trustee. Previously, he served on the Regional Home Visitation Board of Directors and as Treasurer of the Thirteenth Judicial District Bar Association.


Strengths: Attorneys who responded to survey questions rate Judge Hoyer above average for, among others: (1) Overall communications, including speaking clearly, making sure all participants understand the proceedings, using understandable language, and providing written communications that are clear, thorough and well-reasoned; (2) Overall demeanor, which includes giving proceedings a sense of dignity, treating everyone involved politely, treating participants with respect, being consistent in his behavior, and giving all participants an opportunity to be heard; (3) Overall case management, which included promptly issuing a decision on the case after trial and promptly ruling on pre-trail motions. Non-attorney survey participants rated Judge Hoyer high in areas of overall fairness and communications.


Weaknesses: The Commissioners noted that at times, in an attempt to promote fairness, the judge may not set firm enough limits on attorney behavior.


Recommendation: 86% of attorneys surveyed and 85% of non-attorneys surveyed strongly recommended that Judge Hoyer be retained in office. Overall, of those surveyed who made a retention recommendation, 100% of attorneys and 95% of non-attorneys strongly supported or somewhat supported his retention, while 5% of non-attorneys recommended that he not be retained.
