The Seventh Judicial District Commission on Judicial Performance, by unanimous vote, recommends Judge Ben F. Eden BE RETAINED.

Judge Eden graduated from University of Colorado Law School. He spent approximately two years in private practice and eight years as a deputy district attorney. Judge Eden was appointed to the Gunnison County Court bench in 1997. Aside from his work on the bench, Judge Eden periodically speaks in area schools on legal matters.

Judge Eden’s workload consists of twenty-eight percent (28%) civil and seventy-two percent (72%) criminal. Judge Eden’s position is defined by the state as a part-time (85% FTE).

The Commission observed Judge Eden in the courtroom, reviewed his decisions, conducted a personal interview with Judge Eden and reviewed his written self-evaluation. The Commission found Judge Eden to be dignified and courteous in the courtroom. Judge Eden manages his docket in an efficient manner, makes rulings based on the merits of the case at hand and applies the law fairly and consistently.

Eighty percent (80%) of attorneys responding to the evaluation recommended that Judge Eden be retained in office, thirteen percent (13%) recommended that he not be retained, and seven percent (7%) had no opinion. Of the non-attorneys, sixty-eight percent (68%) recommended retention, twenty percent (20%) recommended non-retention, and twelve percent (12%) had no opinion.
