The Twentieth Judicial District Commission on Judicial Performance recommends that Judge Frank Neal Dubofsky BE RETAINED.

This recommendation is based upon survey results from litigants, court staff, jurors, law enforcement personnel, attorneys and others; information received at a public hearing conducted on April 4, 2000; courtroom observations by Commission members; a personal interview conducted with the judge; and other information and materials received.

Judge Dubofsky was appointed to the Twentieth Judicial District Court in Boulder on August 31, 1998. Prior to his appointment as a District Judge, he was in the private practice of law. From 1989 until 1992, he served as a judge on the Colorado Court of Appeals. He received his undergraduate education at Stanford University and his law degree from Georgetown.

Judge Dubofsky's caseload has included civil and criminal matters, probate issues, domestic relations matters, court scheduling and administrative responsibilities and juvenile and family law cases.

From attorneys responding to the survey, Judge Dubofsky's courtroom demeanor and professional temperament are excellent. He treats parties, witnesses, litigants and pro se parties (those appearing without counsel) professionally and with respect. Likewise, he received similar high ratings on his impartiality toward all parties in the judicial process.

Survey results from attorneys indicate the areas of most concern are his case management and docket efficiency skills. His ability to manage cases, use court time efficiently and to produce decisions and rulings in a timely fashion need improvement. Judge Dubofsky has instituted changes that he believes will address these issues.

Judge Dubofsky has good knowledge of the law and its application. The overall rating of Judge Frank Dubofsky is very good. Of the attorneys responding in the survey sample, 86% recommended that Judge Dubofsky be retained in office, 7% recommended non-retention while 7% had no opinion; 81% of non-attorneys favored retention, 8% would not retain and 12% had no opinion as to his retention.

It is the recommendation of the Commission that Judge Dubofsky be retained.
