Judge Clugston was admitted to the bar in 1958 after graduation from law school at the University of Denver. He has served in the United States Navy, worked as a claims examiner and claims manager for an insurance company, worked as a part-time Weld County Deputy District Attorney and Assistant Greeley City Attorney, and was in private practice in Greeley from 1963 to 1973 prior to his appointment in 1973 to the Weld County Court. Judge Clugston has served as a county court judge since 1974.

Judge Clugston currently presides over traffic matters, including drunk driving cases, misdemeanor and petty offense criminal matters, and civil matters involving less than $10,000.

The majority of all the surveyed groups recommended retention for Judge Clugston, with 73.61% of the respondents recommending retention, 16.67% not recommending retention, and 9.72% expressing no opinion. A number of responses to the survey indicated Judge Clugston is an excellent judge, works diligently, displays compassion, maintains good control of his courtroom, and has an excellent knowledge of the law, evidence and procedure. Some law enforcement personnel did state concerns about Judge Clugston in the areas of the clearness of his oral decisions and the fairness of his sentencing.
 
The 19th Judicial District Commission on Judicial Performance recommends that Judge Scott Clugston be Retained.
