The State Commission on Judicial Performance finds that Judge David H. Yun MEETS PERFORMANCE STANDARDS, by a vote of 11 - 0. In evaluating Judge Yun, the Commission considered Colorado's statutory judicial performance standards -- namely: integrity, legal knowledge, communication skills, judicial temperament, administrative performance, and service to the legal profession and the public. 

Judge Yun has been on the Colorado Court of Appeals for just over two years and this is his first retention evaluation as a Court of Appeals judge. The Commission finds his opinions to be clear, analytical, succinct, conscientious and well-reasoned. During oral arguments, Judge Yun exhibits a polite and professional demeanor and shows his knowledge of both the facts of the case and the applicable law through the questions he asks. The Commission encourages Judge Yun to continue to deepen his knowledge of areas of law in which he did not previously practice, such as criminal law, domestic relations, and dependency and neglect. The Commission finds that Judge Yun is a valuable addition to the Colorado Court of Appeals.

In conducting its evaluation, the Commission interviewed Judge Yun, reviewed his self-evaluation, observed oral arguments, read a selection of his legal opinions, and considered survey responses from attorneys and judges. One survey question asked whether Judge Yun met judicial performance standards. While there were insufficient attorney responses with relevant knowledge to respond to this question, of the judges who responded to that question, 88% answered yes, 7% answered no, and 5% had no opinion. The written comments from both the attorneys and judges in the survey were overall very positive.

Judge Yun was appointed to the Court of Appeals in December 2019 and was sworn in as judge in March 2020. He grew up in the Denver suburbs and graduated from Arapahoe High School. In 1989 he graduated from the University of Colorado in Boulder, earning a Bachelor of Arts in economics and political science. He then went on to receive his law degree from the University of Colorado School of Law in 1993. Before joining the Court, he focused his private law practice primarily on civil appeals, health care law, and medical malpractice. He is a fellow of the Litigation Counsel of America. He serves as a member of the Colorado Civil Jury Instructions Committee as well as the Colorado Bar Association's Ethics Committee. Judge Yun is a frequent speaker to the legal community, students, and the broader public on a variety of topics, including appellate law, diversity issues, and the impact of COVID on the judicial system.
