The Seventh Judicial District Commission on Judicial Performance voted 9-0 (one member absent) to recommend that Judge Ben F. Eden BE RETAINED.
Judge Eden was appointed as Gunnison County Court Judge in April of 1997. Prior to this appointment he served in Gunnison as Deputy District Attorney for the 7th Judicial District from 1989 to 1997. A Gunnison native, Judge Eden earned a BA from Western State College in 1980 and an MBA from Western in 1981. He attended the University of Colorado Law School earning his law degree in 1986. He has practiced law in Gunnison County since that time. His case workload over the past two years has consisted of 85% criminal cases (including traffic infractions) and 15% civil cases. Judge Eden's caseload includes civil, criminal (misdemeanor and felony) and traffic cases.
Judge Eden is strong in the areas of commitment to his profession, calm demeanor in the courtroom, thoroughness, and equal treatment of persons in the courtroom. The Commission felt that Judge Eden has shown significant progress since his last performance evaluation in acknowledging areas where he needed improvement and addressing them. These areas included improving on prompt issuance of rulings and avoiding even the appearance of impropriety in his dealings with attorneys and litigants.
Of all attorneys surveyed about retention, 83% recommended to retain, 9% not to retain, and 9% were undecided or didn’t have enough information to make a recommendation. Of those expressing an opinion to retain or not to retain, 91% recommended to retain and 10% not to retain. Of all non-attorneys surveyed, 79% recommended to retain, 12% not to retain, and 10% were undecided or didn’t have enough information to make a recommendation. Of those expressing an opinion to retain or not to retain, 87% recommended to retain and 13% not to retain. (These percentages may not total 100% due to rounding.)
