The First Judicial District Commission on Judicial Performance recommends by a unanimous vote that Judge Bradley Allen Burback BE RETAINED.
Judge Burback received his Bachelors of Arts degree from Colorado State University and his law degree from the University of Baltimore School of Law. He was appointed to the Jefferson County Court in 2008. Before his appointment to the court, Judge Burback was a Deputy District Attorney for the First Judicial District and a District Court Magistrate for the First Judicial District. He handles a mix of traffic, criminal and misdemeanor cases. His community interests include serving as a volunteer Sunday school teacher and a den leader for Cub Scouts. He is a member of the American Bar Association’s Military Pro Bono Project, and has been involved judging moot court competitions.
The Commission considered responses to anonymous surveys sent to attorneys and non-attorneys who had been in Judge Burback’s courtroom, unannounced courtroom visitations by Commission members, a self-evaluation by Judge Burback, and a personal interview with Judge Burback in reaching its recommendation regarding Judge Burback. Judge Burback is before the Commission for the first time, after just three years on the bench. He participates in numerous classes, conducting research, and preparing well for his cases. Comments received by both attorneys and non-attorneys show that he is patient, thorough, and treats people in his courtroom with respect and compassion. He has worked hard to improve the efficiency of his docket. Some survey comments suggest that he was prosecution oriented and a hard sentencer. While he does not believe that he shows preference, he has taken that criticism seriously and is working to change that perception. The Commission believes Judge Burback is doing an excellent job now and is dedicated to steadily improving his skills.
Of all attorneys surveyed about retention, 72% recommended to retain, 17% not to retain, and 11% were undecided or didn’t have enough information to make a recommendation. Of those expressing an opinion to retain or not to retain, 81% recommended to retain and 19% not to retain. Of all non-attorneys surveyed, 91% recommended to retain, 2% not to retain, and 7% were undecided or didn’t have enough information to make a recommendation. Of those expressing an opinion to retain or not to retain, 97% recommended to retain and 2% not to retain. (These percentages may not total 100% due to rounding.) Based upon its review of the information presented to it, the First Judicial District Performance Commission is pleased to recommend unanimously that Judge Bradley Allen Burback of the Jefferson County Court BE RETAINED
