The 18th Judicial District Commission on Judicial Performance unanimously recommends that Judge Palmer L. Boyette BE RETAINED.
Judge Boyette became Magistrate for the Denver Juvenile Court in 2001 and was subsequently transferred to the Denver District Court, where he still serves part time as a Magistrate. In 2007, Judge Boyette was appointed to the bench and he now also serves part time in Elbert County. He graduated with a Bachelor of Arts in History from Florida State University in 1986. He graduated from Florida State Law School in 1989. Prior to his appointment, Judge Boyette worked as an Assistant City Attorney in Denver, and as a Senior Attorney in the Florida Department of Children and Families. He also worked in private practice and as an Assistant Public Defender in Naples Florida.
The Commission observed him in Court, conducted a personal interview, reviewed opinions he authored and reviewed surveys completed by attorneys and non-attorneys. Fifty-Four attorneys responded to the survey and of those, 86% recommended that he be RETAINED, 3% recommended he not be retained, and 12% made no recommendation regarding retention. With respect to the non-attorneys, of the 115 who responded to the survey, 82% recommended that he be RETAINED, 12% recommended he not be retained, and 6% made no recommendation regarding retention. (These percentages may not total 100% due to rounding.)
Judge Boyette is currently handling a diverse docket in Elbert County consisting of criminal, civil, misdemeanors, traffic infractions and small claims cases. He has received above average ratings from attorneys in many areas including application and knowledge of the law, issuing consistent sentences when circumstances are similar, treating participants with respect and setting reasonable schedules for cases. Although his marks from non-attorneys were slightly lower in these areas, his retention recommendation from this group was 82%. Due to the forgoing reasons, the Judicial Performance Commission unanimously recommends that Judge Palmer L. Boyette be retained.
